Law 11/2023 on Digitalization

Law 11/2023 of 8 May promotes the digitalization of public administration with accessibility as a cross-cutting requirement. It mandates that all digital procedures, electronic notifications, digital signatures and electronic registries must be fully accessible.

What is Law 11/2023?

Law 11/2023 of 8 May is a broad Spanish law transposing several European directives on digitalization. By establishing that the relationship between citizens and public administration must be digital by default, it implicitly requires that all procedures, notifications and electronic services be fully accessible. The law reinforces the framework of RD 1112/2018 by expanding what must be accessible: not just websites and apps, but also electronic administrative procedures, digital notifications, electronic signature systems and electronic registries. Our team advises public administrations on meeting these requirements, ensuring no citizen is excluded from digital public services.
  • 1

Establishes the digital channel as the primary interface between citizens and public administration.

  • 2

Requires accessibility in electronic procedures, digital signatures and notifications.

  • 3

Reinforces RD 1112/2018 by expanding the scope of obligated digital assets.

  • 4

An inaccessible digital procedure may invalidate the resulting administrative act.

Value proposition

Why we are different

We build sustainable and scalable accessibility infrastructures.

[01]

Legal Validity of Actions

Accessibility protects the legal validity of resolutions and administrative acts issued through digital channels.

[02]

Inclusion of All Citizens

More than 4.3 million people with disabilities in Spain have the right to an accessible digital administration.

[03]

Comprehensive Regulatory Compliance

Our approach covers Law 11/2023, Royal Decree 1112/2018, and UNE 301 549 in an integrated manner.

[04]

Reduction of Complaints

An accessible digital administration drastically reduces complaints, appeals, and liability claims.

[05]

Efficiency in Digital Transformation

Integrating accessibility from the design stage is more efficient than remediation, reducing long-term costs.

[06]

Improved Citizen Relations

Accessible procedures improve citizen satisfaction, reduce in-person visits, and expedite processing times.

Risks of non-compliance

Lack of accessibility in digital procedures has direct legal consequences for the validity of administrative actions.

Nullity of administrative actions

An inaccessible digital procedure can violate the right to equality, and the resulting decisions may be annulled.

Citizen complaints and claims

Citizens can file formal complaints with the Ombudsman regarding barriers in digital procedures.

Compensation

If a citizen with a disability suffers harm due to being unable to complete a procedure, they can claim compensation.

Exclusion from public procurement

Technology companies whose products do not comply may be excluded from digitization tenders.

Everything you need to know

RD 1112/2018 focuses on websites and mobile apps. Law 11/2023 expands the scope to include electronic procedures, digital signatures, notifications and registries — essentially the entire digital administration infrastructure.
It reinforces existing ones by establishing that the digital channel is the primary interaction method, making accessibility a fundamental requirement rather than an optional enhancement.
An administrative procedure conducted through an inaccessible platform may be legally challenged. Citizens have the right to file complaints with the Defensor del Pueblo.
