Did you know that...

Since September 20, 2018, the Royal Decree 1112/2018 has been in force regarding the accessibility of public sector websites and mobile applications. This decree mandates that all public administration websites or those dependent on it must be accessible to people with different abilities.

This legal regulation applies to all public sector web spaces, from those belonging to administrations, courts, and police services, to hospitals, universities, and public libraries, among others. Additionally, in Article 17 of the aforementioned Royal Decree, the requirements regarding when and how accessibility reviews must be carried out are specified to maintain their adequacy over time; a regulation that came into force on November 1, 2018.

What must be fulfilled?

The Royal Decree not only mandates that websites be accessible based on a level of adequacy established by the accessibility guidelines WCAG 2.1, but also establishes a series of actions, implementations, and documentation that must be prepared and sent to the Ministry of Economic Affairs and Digital Transformation. This ministry will be responsible for submitting all the information regarding its web platform to the European Commission before December 2021.

Actions to be carried out

  • Define an Accessibility Committee within the entity/organization, which will be responsible for monitoring accessibility matters.
  • Enable a contact form on the website for accessibility-related issues and manage all incoming requests. The mentioned Accessibility Committee will have among its functions the management of received requests.
  • Conduct a comprehensive accessibility analysis, if not previously developed, to evaluate the adequacy level of the website (A or AA according to WCAG 2.1).
  • Include an Accessibility Statement on the website, based on the European accessibility statement model, which must be reviewed annually.
  • Send the following documentation to the ministry:
    1. Accessibility review report (once a year, and if substantial changes occur, before October each year)
    2. Report on the handling of complaints and claims (annually)
    3. Compliance monitoring report (annually)
    4. Promotion, awareness, and training monitoring report (annually)

The public institution in question must apply the recommended changes so that the accessibility limitations of its web portal are resolved.
