Currently, it is vitally important that public administrations comply with the established Web Accessibility standards.
Specifically, the need to periodically renew the Accessibility Review Report is notable in order to prevent possible economic sanctions, significant legal consequences and avoid loss of image and credibility.
So, what am I exposing myself to if I have not yet renewed my IRA? We tell you!
Legal non-compliance and economic sanctions
Failure to comply with web accessibility regulations can result in significant economic and legal sanctions for public administrations.
In Spain, Royal Decree 1112/2018 establishes that public administration websites should have their Accessibility Review Report duly completed by September 20, 2018 and that, in addition, this report should be renewed as maximum every 3 years and be reviewed annually.
Today this imposes a scenario in which every public administration should have its IRA renewed or reviewed now, specifically before the month of October of each year.
The importance of the Accessibility Declaration.
In addition to the renewal of the IRA, public institutions must also carry out an annual review of their Accessibility Declaration, Complaints and Claims Response Report, Promotion, Awareness and Training Monitoring Report and must review the evaluation of the disproportionate load of their web portals.
It should be noted that all those entities that have not renewed or reviewed their IRA, as well as the rest of the relevant reports, could be contacted by the Web Accessibility Observatory to demand due compliance with the regulations, exposing themselves to the possibility of receiving fines and financial penalties imposed by the competent authorities.
Risk of loss of financing
In addition to direct financial sanctions, failure to comply with web accessibility can lead to the loss of funding or subsidies for public administrations.
In some cases, if a public administration does not renew its Web Accessibility Review Report and does not comply with the required requirements, it may lose access to these financial resources, which would further affect its ability to develop projects and programs for the benefit of citizens.
Legal liability
On the other hand, failure to comply with web accessibility regulations and failure to renew the Web Accessibility Review Report can also expose public administrations to certain legal responsibilities.
People with disabilities who are affected by lack of accessibility on public administration websites can file legal claims seeking compensation for discrimination or access barriers.
These lawsuits can result in significant legal costs, as well as obligations for reparation and financial compensation.
If a public sector company does not guarantee the accessibility of its website, this can generate criticism and a negative perception towards the administration, which can affect its image and credibility.
